Time/temperature control for safety food cold held at greater than 41 degrees Fahrenheit. Observed in reach in cooler Raw scallops (45F - Cold Holding). Scallops towards to very top of pan with service towel under them. Employee removed and placed inside of reach in cooler.
Operator is doing a special process, conducting reduced oxygen packaging, cooking time/temperature control for safety food to a time and temperature combination lesser than those in the Food Code or operating a molluscan shellfish tank for human consumption without a HACCP plan approved by the Division of Hotels and Restaurants. Reach in cooler has an ambient temperature of 44.6F. Employee was refilling unit during inspection. Employee placed ice on all TCS items on flip top cooler.

Observed employee washed his hands then use the paper towel he used to dried his hands to wiped his face, then put on gloves and then handled container of sauce. After reviewing with employee he re wash his hands.

Cooked egg yolks not date marked in salad prep reach in cooler. Manager stated egg yolks container was opened on 7/22 and voluntarily discarded eggs.
Ceiling not smooth, nonabsorbent and easily cleanable in food preparation, food storage, or warewashing areas. Unsealed wood rack attached to ceiling above bar station.
